Terms and Conditions

1. Who we are

Gymy is an access control and member management service operated by Examin SRL, Oradea, Romania ("Examin SRL", "we"). These Terms and Conditions (the "Terms") govern your access to and use of the Gymy applications, websites and services (together, the "Service").

2. Acceptance of the Terms

By creating an account, starting a trial or using the Service, you agree to these Terms on behalf of the company you represent. If you do not agree, do not use the Service. If you have a separate written contract with us, that contract prevails where there is a conflict.

3. The Service

Gymy provides access control with face recognition or QR codes, member and membership management, payments, alerts, reports and IoT access control for turnstiles, gates and doors. The Service runs on Android devices you own and manage. Features may evolve over time; we will not materially reduce the core functionality of a paid plan during the period you have paid for.

4. Your account

You must provide accurate information at sign-up and protect your login credentials. You are responsible for all activity in the account and for making sure only authorised administrators can access it. Tell us immediately at contact@examin.ai if you suspect unauthorised access.

5. Trial, plans and billing

New customers get 30 days free, with full functionality. Paid plans are set by member count tiers, as shown on the pricing page. Unless we agree otherwise, subscriptions renew automatically and can be cancelled at any time, effective at the end of the current billing period. If your member count grows into a higher tier, we may move you to the matching plan at the next renewal. Price changes are announced at least 30 days in advance.

6. Your responsibilities as the gym's controller

You act as the data controller for your members' data, including biometric data. Before enrolling a member you must have a legal basis, obtain the consent required by applicable law, inform members how the system works and respect their rights. You must comply with all applicable privacy and biometric laws (for example the GDPR). The Service may not be used for covert surveillance.

7. Acceptable use

You must not misuse the Service. This includes: attempting to access other customers' data, reverse engineering or copying the Service, circumventing security measures or usage limits, uploading illegal content, or reselling the Service without our written agreement.

8. Your data and intellectual property

Your data belongs to you, including your access records and your members' biometric templates. You grant us the limited rights needed to host, process and back up that data in order to operate the Service. We (and our licensors) own the Service, the software and the brand.

9. Availability and warranties

We work to keep the Service fast and available, but it is provided "as is" and "as available". We do not warrant that the Service will run uninterrupted or error free, nor that face recognition will be accurate in every environment. Physical access decisions (gates, doors) remain your responsibility; always keep a safe manual alternative.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, and our total liability under these Terms is limited to the amounts paid for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Termination

You can leave the Service and cancel at any time. We may suspend or terminate the Service for a serious breach that is not remedied within 30 days of notice. After termination, your data remains available for export for 30 days, then it is deleted in line with the Privacy Policy.

12. Governing law

These Terms are governed by the laws of Romania. Disputes are settled by the competent courts of Oradea, Romania.

13. Changes to the Terms

We may update these Terms from time to time. If a change is significant, we give you at least 30 days' notice before it takes effect. Continuing to use the Service after that date means you accept the updated Terms.
